Terms of Service

Welcome to Swear Jar! These Terms of Service ("Terms") govern your use of the Swear Jar mobile application (the "App") operated by SwearingJar LLC ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws

2. Description of Service

Swear Jar is a personal accountability app that helps users reduce unwanted speech habits by:

• Recording audio and detecting user-defined keywords
• Tracking virtual "charges" for detected words
• Setting and monitoring frequency goals
• Joining accountability groups ("Circles") with other users
• Viewing progress statistics and achievements

3. Account Registration

Account Creation

To use the App, you must create an account using a valid email address. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

One Account Per Person

You may only create and maintain one account. Creating multiple accounts may result in termination of all accounts.

4. Virtual Currency

The virtual charges are designed to help you visualize the impact of your speech habits. They have no monetary value and cannot be redeemed, transferred, or converted to real currency.

5. Acceptable Use

You agree not to use the App to:

• Record others without their knowledge or consent
• Share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Harass, bully, or intimidate other users through Circles
• Impersonate any person or entity
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any part of the App
• Use the App for any commercial purpose without authorization
• Violate any applicable laws or regulations

6. Circles (Accountability Groups)

Circles allow users to form accountability groups and share progress. When using Circles, you agree to:

Respectful Conduct

• Treat all Circle members with respect
• Use Circles for supportive accountability, not harassment
• Respect the privacy settings of other members
• Not share screenshots or information from Circles without consent

Circle Administration

• Circle creators have the right to remove members
• Removed members may not harass circle creators or members
• We reserve the right to remove Circles that violate these Terms

7. User Content

Your Content

You retain ownership of any content you create, including:

• Custom keywords you define
• Your display name and profile photo
• Circle names and descriptions you create

License to Us

By using the App, you grant us a limited license to store, process, and display your content as necessary to provide the service.

Prohibited Content

You may not create keywords, circle names, or display names that contain:

• Hate speech or discriminatory language
• Threats of violence
• Illegal content
• Personal information of others without consent

8. Intellectual Property

The App, including its design, features, and content, is owned by SwearingJar LLC and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Remove any copyright or proprietary notices
• Use our trademarks without permission

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimers

We disclaim all warranties, express or implied, including:

• Merchantability and fitness for a particular purpose
• Accuracy or reliability of transcription
• Uninterrupted or error-free operation
• Results from using the App

The App is designed as a personal improvement tool. We make no guarantees about:

• Your ability to reduce unwanted speech habits
• The accuracy of keyword detection
• The behavior of other users in Circles

11. Limitation of Liability

To the maximum extent permitted by law, SwearingJar LLC shall not be liable for any:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Damages resulting from unauthorized access to your account
• Damages arising from interactions with other users

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, if any.

12. Indemnification

You agree to indemnify and hold harmless SwearingJar LLC from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the App
• Content you create or share
• Your interaction with other users

13. Termination

By You

You may stop using the App and delete your account at any time through the App settings or by contacting us.

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Harass other users
• Create multiple accounts

Effect of Termination

Upon termination, your right to use the App ceases immediately. We may delete your data in accordance with our Privacy Policy.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Sending a notification
• Updating the "Effective Date"

Continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Resolution: Contact us first to attempt to resolve the dispute
2. Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration in Delaware

You agree to waive any right to a jury trial or class action lawsuit.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SwearingJar LLC regarding the App.
